Criminal Bail Release Form of Order

A Criminal Bail Release Form of Order is now available for Counsel and Court use here: https://www.albertacourts.ca/qb/areas-of-law/criminal/forms.

Counsel may use this form of order where bail is being consented to, and to propose release where bail is being contested/spoken to at a bail/bail review/hearing.

The benefits of Counsel using this new form of order are:

  • an additional/separate release order is no longer required;
  • Counsel will no longer be required to obtain approval from the Crown to the form of order following a bail/bail review hearing;
  • in contested matters, Counsel will no longer be required to obtain the signature of the Justice as the Justice will be signing the Criminal Bail Release Form of Order at the hearing;
  • and the Order will be served digitally on the holding facility.

This process essentially replicates the process used in Provincial Court for bail orders and eliminates a number of manual steps. While Counsel will no longer be required to serve the bail/bail review order on the holding facility, they will continue to be responsible for serving the order on the Provincial Court (if the matter is still in that Court) and on all other interested parties.
